You've read more than enough already about how Novell and Microsoft signed an agreement that's supposed to help Novell sell Linux to Microsoft customers and help Microsoft customers integrate Linux -- as long as it's Novell Linux -- into their IT environments without fear of patent lawsuits. Part of the yammer was an open letter from Novell's CEO claiming that deal didn't really mean what you thought it did, followed by a statement from Microsoft that said Novell's CEO didn't really mean to say what he said or was wrong about some of it. Or something. Then Mark Shuttleworth jumped into the mess by offering a new, Microsoft-free home for openSUSE developers who didn't want to truck with Novell any longer because of its Microsoft deal.

Was the Novell/Microsoft deal a worthwhile well-meaning effort between renegade open-source geeks at Microsoft and geeks at Novell that got derailed by salespeople and management, after which it was turned into a nightmare deal with the devil? I raise this question because I know someone with ties to people at both Microsoft and Novell. He has a credible story to tell about what really happened, and how much it differs from what we now know about the Novell/Microsoft deal. Unfortunately, I haven't been able to get him to write up the history - yet. Two years ago this month, Microsoft Corp. forged its controversial partnership with Novell Inc. that, among other things, had the two companies agreeing not to sue each other over intellectual property issues, in part to protect SUSE Linux users over any patent litigation from Microsoft. A Question About the Novell-Microsoft Deal

It's about the latest Novell-Microsoft deal that was announced on August 20, where Microsoft agreed to buy another $100 million worth of vouchers from Novell. I was wondering: how come two public companies can make a deal that seems to me to be material and yet keep pieces of the deal secret?
