The other day I was browsing WordPress Planet and noticed a link to 31 free WordPress themes from WordPress Diva. Of course, the"free" is as in beer, and the license requires that you display two links embedded in the theme"as long as the theme is in use." I don't mean to pick on Diva in particular, but I would like to illustrate why these sorts of"linkware" licenses, or licenses requiring reciprocal links, can be a bad idea.

Why Torvalds is sitting out the GPLv3 process

Why isn't Linus Torvalds involved with the drafting of the third version of the GNU General Public License (GPL)? Torvalds has frequently criticized the process and the drafts of the GPLv3, and recently voted against the license in an informal poll of kernel developers, so it seems obvious to question why he chose to sit out the process. Torvalds gives his reasons as a dislike of committees, an inability to contribute in his preferred way, and philosophical differences with the Free Software Foundation (FSF), which he suggests is trying to absorb other licenses under the GPL.[What would be wrong with absorbing other licenses under the GPL? That could essentially reduce the number of licenses one has to worry about, couldn't it? - dcparris]

Let's look at this concept a bit more. This deal between Microsoft and Novell isn't about getting Linux to play nice with Windows...it's about patents, intellectual property, and indemnification licenses.

Red Hat flags OSI offenders on partner site

Sometimes being the open source software leader means distancing yourself from open source claims. Red Hat has bowed to pressure and improved the way it describes partner software licenses on the Red Hat Exchange (RHX). The licenses of companies such as SugarCRM, Zimbra and Alfresco used to be buried on the RHX site, requiring interested customers to spend considerable time finding the documentation. This hide-the-license policy angered some open source advocates who argued that Red Hat gave the misleading impression that all RHX vendors had Open Source Initiative (OSI)-approved licenses. Now, Red Hat is working to banish broad"open source software" claims from the RHX marketplace.

I guess you saw the news about Microsoft submitting some licenses to OSI hoping for approval as"open source" licenses. You can watch Bill Hilf of Microsoft giving his talk at OSCON, which is where the stories emanated from. That, to me, wasn't the news, since a Microsoft license was submitted once before, although I gather not by the company. But what I'm noticing is reactions. ComputerWorld collected some truly astonishing responses, and if you follow their links, it gets worse.
