BSD Licensed PCC Compiler Imported

Anders Magnusson's BSD-licensed pcc compiler has been imported into CVS. He wrote to NetBSD's tech-toolchain list:"It is not yet bug-free, but it can compile the i386 userspace. The big benefit of it (apart from that it's BSD licensed, for license geeks :-) is that it is fast, 5-10 times faster than gcc, while still producing reasonable code. The only optimization added so far is a multiple-register-class graph-coloring register allocator, which may be one of the best register allocators today. Conversion to SSA format is also implemented, but not yet the phi function. Not too difficult though, after that strength reduction is high on the list."

In the wake of recent flareups over the inclusion of BSD licensed code in GPL licensed programs, a little extra vigilance can go a long way. Recently, Fedora package managers manually reviewing code licenses in a new version of Joop Stakenborg's popular XLog program used by amateur radio enthusiasts around the globe to record their contacts discovered a change in the licensing of one of the included files which impacted the licensing of the program as a whole.

The NetBeans community has released the latest build of its open source, Java-based integrated development environment (IDE) with, among other new features, a dual-licensing scheme. NetBeans 6.0 Beta 2 is licensed under both the GNU General Public License (GPL) v2 with ClassPath exception and Sun Microsystems' Common Development and Distribution License (CDDL). NetBeans creator and primary corporate sponsor Sun Microsystems proposed adding the GPL license option.

Can Linspire Still Feed on Ubuntu (or Debian) Linux Codebase?

Earlier this week, just less than a couple of months after their seemingly-friendly deal, Microsoft betrayed Linspire. There are more questions to be raised and implications to discuss. Microsoft has disavowed any GPLv3-licensed software. Ubuntu will be moving toward the new toolchain, which is GPLv3-licensed. Linspire needs Ubuntu, which is the core on which it builds its products. If Linspire carries on adopting Ubuntu as its codebase or even falls back (some would say 'forward' ) to Debian, any 'patent indemnification' will then be rendered moot.

In a recent series of patches posted to the Linux Kernel mailing list, it was proposed that some imported Atheros wireless device drivers be re-licensed, some from a dual-BSD/GPL license, others from a modified BSD license, all to a pure GPLv2 license. Christoph Hellwig asked,"is this really a good idea? Most of the reverse-engineering was done by the OpenBSD folks, and it would certainly be helpful to work together with them on new hardware revisions, etc.." Luis Rodriguez suggested that there was no choice,"technically the best we can do is to leave the license as dual licensed, but keep in that technically that means nothing and is just for show, the GPL is what would apply as its derivative work and is the most restrictive license."

"What is going on whenever someone changes a code is that they make a'derivative work'," began Theodore Ts'o."whether or not you can even make a derivative work, and under what terms the derivative work can be licensed, is strictly up to the license of the original. For example, the BSD license says:'redistribution and use in source and binary forms, with or without modification, are permitted provided that the following conditions are met....' Note the'with or without modification'. This is what allows people to change BSD licensed code and redistribute said changes." He added,"it is not a relicencing, per se, since the original version of the file is still available under the original copyright; it is only the derived work which is under the more restrictive copyright."
