OSI Approves New Open-Source License

The Open Source Initiative approved on July 25 its first new license in quite some time: the Common Public Attribution License, which is essentially the Mozilla Public License with a new attribution clause. TAPR introduces open source hardware license, OSI skeptical

The Tucson Amateur Packet Radio (TAPR) organization is sponsoring a new open-source license intended for hardware components. Authored by lawyer John Ackermann, the Open Hardware License (OHL) is a share-alike license that developers can apply to documentation and schematics associated with hardware projects. The license stipulates that those who distribute products based on OHL-licensed hardware specifications may not file patent infringement lawsuits against others who use the same hardware specifications.

With arguments about changes to the GNU General Public License (GPL) still sizzling, the Free Software Foundation (FSF) has released a discussion draft of the new version of the GNU Free Documentation License (FDL). Many of the changes to the FDL mirror those to the GPL, including increased clarity of language and changes in wording to make internationalization clearer. In addition, the draft expands the license to make it suitable for audio and video, defines fair use, and introduces the Simpler Free Documentation License (SFDL), which is presented as a more straightforward alternative to the FDL. However, it seems questionable whether these changes will be enough to silence previous criticisms.

Linux: Relicensing Code

In a recent series of patches posted to the Linux Kernel mailing list, it was proposed that some imported Atheros wireless device drivers be re-licensed, some from a dual-BSD/GPL license, others from a modified BSD license, all to a pure GPLv2 license. Christoph Hellwig asked,"is this really a good idea? Most of the reverse-engineering was done by the OpenBSD folks, and it would certainly be helpful to work together with them on new hardware revisions, etc.." Luis Rodriguez suggested that there was no choice,"technically the best we can do is to leave the license as dual licensed, but keep in that technically that means nothing and is just for show, the GPL is what would apply as its derivative work and is the most restrictive license."

What's more, the author is actively censoring attempts to advise the userbase of the license change, and appears to be making an attempt to retrospectively re-license all prior versions as well.
